What Our Clients Say

What Is a Motorcycle Lemon Law Claim in California?

California’s Lemon Law (Song-Beverly Consumer Warranty Act) protects consumers who buy or lease new motorcycles that turn out to be defective. Motorcycles are considered “consumer goods,” and you may have a Lemon Law claim if:

1

Your motorcycle has a serious defect covered under the manufacturer’s warranty.
2

You’ve given the dealership or manufacturer multiple opportunities to fix the issue without success.
3

The defect substantially impairs the motorcycle’s use, safety, or value.

Common issues that can make a motorcycle a “lemon” include:

  • Engine malfunctions or failure
  • Electrical system defects
  • Brake malfunctions
  • Steering instability
  • Sudden loss of power
  • Frame or design defects

If your bike qualifies, you may be entitled to a full refund (buyback) including down payment, loan payments, registration, and taxes, or even a replacement motorcycle. Some cases lead to civil penalties (up to two times your actual damages) if the manufacturer willfully violated the law, and most cover attorney’s fees and costs (paid by the manufacturer), as well.

When your safety is on the line, you have the right to demand better.

We Handle Tough Motorcycle Lemon Law Cases

  • Working with motorcycle mechanics and safety professionals

Proven Results for Motorcycle Lemon Law Clients

At Cha Cha Cha Law, we’ve helped motorcycle owners across California achieve powerful results, from securing full buybacks and cash settlements for defective motorcycles to winning civil penalties when manufacturers dragged out or mishandled claims. We’ve also helped our clients get attorney’s fees and costs paid fully by the manufacturer, and helped riders move on from bad bikes to safer, more reliable rides.

Every case we take is about more than just the money, it’s about restoring your safety, freedom, and peace of mind.

A look at one of our resolved cases:

A 2021 Harley-Davidson FLHR was brought in twice for the same unresolved issue involving high idling and stalling when shifting from 2nd to 3rd gear. During the first visit, the motorcycle was out of service for over 30 days, but diagnostics revealed no faults and the issue persisted. The customer returned several months later with the same complaint, though no resolution was documented.

The case settled with Harley-Davidson and the dealership agreeing to fully reimburse the client and cover all legal fees.

Frequently Asked Questions

Does California Lemon Law cover motorcycles?

Yes! Motorcycles intended for personal, family, or household use and sold or leased with a warranty are covered. Off-road-only bikes are not covered.

What defects qualify a motorcycle as a lemon?

Serious engine problems, brake failures, electrical issues, loss of power, steering defects, and other problems that impact the bike’s use, safety, or value may qualify.

How many repair attempts are required?

Generally, two or more repair attempts for safety-related issues, or four or more for non-safety defects, may meet the threshold under California law.

How long do I have to file a Lemon Law claim for my motorcycle?

Under California’s updated rules (AB 1755), you generally must file within one year after your express warranty expires and no later than six years from the motorcycle’s delivery date. Written notice and mandatory mediation are now required before suing for penalties.

What if the dealer says my bike is “normal” or “fine”?

Don’t rely on the dealer’s opinion. If your motorcycle still isn’t safe or reliable after repairs, you may still have a valid Lemon Law claim.

What compensation can I recover in a motorcycle Lemon Law case?

You may recover a buyback, replacement bike, civil penalties, reimbursement for costs like registration and taxes, and attorney’s fees.

Will I have to go to trial?

Many motorcycle Lemon Law cases settle out of court, but we always prepare every case to go to trial if necessary to maximize your results.

How much does it cost to hire Cha Cha Cha Law?

Nothing upfront. We work on contingency, meaning we only get paid if we win your case, and the manufacturer typically covers our legal fees.
